Question: I am a single mother of two children. Can I request my employer to allow me to work from home during periods when schools shift online as they did from May 5–8? My employer is not very flexible with remote work arrangements, so I often end up taking annual leave instead. What does UAE Labour Law say about this?

Answer: Pursuant to your queries, it is assumed that the provisions of the of the UAE employment law and the cabinet resolution are applicable on your employer.

An employee may work remotely, fully or partially, provided it is agreed between the employer and employee. This is in accordance with the Article 5 (1) (a) of the Cabinet Resolution No.(1) of 2022 On the Implementation of Federal Decree-Law no. (33) of 2021 Regarding the Regulation of Employment relations (the “Cabinet Resolution No. (1) of 2022), which states:

This is in accordance with Article 10 (3) of the Cabinet Resolution No. (1) of 2022:

    2. The employee and the employer may agree to introduce new clauses to the approved contract forms, provided that they are in agreement with the provisions of the Decree-Law, this Resolution and the Legal Regulations.

    3. The contract may be changed from one work type to another subject to the following:

    a. Approval of both the worker and the employer.

    b. Payment of all the entitlements arising from the original contract.

    c. Compliance with the procedures as set out by the Ministry.
